Welcome to Shabbat Mode ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Shabbat Mode app ("App") and related services ("Service") provided through the Shopify App Store.
By installing or using the App on your Shopify store, you agree to be bound by these Terms. If you do not agree, do not install or use the App.
1. Description of Service
Shabbat Mode is a Shopify app designed to help merchants automatically manage certain online store functions according to predefined time settings (for example, during Shabbat or holidays).
The App integrates with your Shopify store to modify certain display or functionality settings at scheduled times, depending on your configuration.
2. Acceptance of Terms
By installing and using the App, you confirm that you are authorized to act on behalf of the Shopify store owner and have the legal capacity to enter into this agreement.
We may update or modify these Terms from time to time. The most current version will always be available on this page, and your continued use of the App after changes take effect constitutes acceptance of the new Terms.
3. License & Access
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on your Shopify store, solely for your internal business purposes in connection with that store.
You may not:
- Copy, modify, or distribute the App's code or content.
- Attempt to decompile or reverse-engineer the App.
- Use the App in violation of Shopify's Terms of Service or any applicable law.
- Install or use the App for any illegal or fraudulent purpose.
4. User Responsibilities
You are solely responsible for:
- Correctly configuring and using the App within your Shopify admin.
- Reviewing the App's documentation and ensuring it functions as intended on your store.
- Maintaining backups and verifying that your store operates correctly before and after changes are applied.
We do not provide guarantees that the App will function flawlessly with every store theme, third-party app, or customization.
5. Fees & Payments
Some features of the App may be available under a paid subscription plan. You agree to pay all fees described at the time of installation or subscription. All payments are processed through Shopify's billing system and are subject to Shopify's billing terms. Fees are non-refundable except where required by law.
6. No Guarantee of Sales or Performance
You acknowledge and agree that your use of the App does not guarantee any specific sales, performance, or business outcomes.
While the App is designed to support your store operations, we make no warranties or representations that it will increase revenue, conversions, or operational efficiency.
We are not responsible for any loss of sales, revenue, data, or customers that may occur as a result of:
- Using or not using the App,
- Incorrect configuration or installation,
- Downtime, technical errors, or conflicts with your theme or other apps, or
- Any other cause beyond our reasonable control.
Your store remains your responsibility, and you should test and verify all App settings before enabling them in a live environment.
7. Intellectual Property
All rights, title, and interest in the App (including source code, design, logos, trademarks, and documentation) are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works based on any part of the App without written consent.
8. Third-Party Services
The App may integrate with Shopify APIs or other third-party systems. Your use of those services is governed by their respective terms. We are not responsible for the operation or security of third-party services.
9. Disclaimer of Warranties
The App is provided "as-is" and "as-available," without any warranties, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or compatible with every theme, plugin, or store configuration.
10. Limitation of Liability
To the maximum extent permitted by law, we (and our officers, employees, contractors, and affiliates) shall not be liable for any indirect, incidental, consequential, special, or punitive damages - including but not limited to loss of profits, sales, revenue, data, or goodwill - arising from your use or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability for any claim shall not exceed the total amount paid by you for use of the App during the twelve (12) months preceding the event giving rise to the claim.
11. Termination
You may uninstall the App at any time through your Shopify admin. We may suspend or terminate your access to the App if you violate these Terms or misuse the Service. Upon termination, your right to use the App immediately ends.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to conflict of law principles.
13. Severability
If any part of these Terms is found unenforceable, that portion shall be enforced to the maximum extent possible, and the remainder shall continue in full effect.
14. Entire Agreement
These Terms, along with any policies referenced herein (including our Privacy Policy), constitute the entire agreement between you and us regarding the App.
